1. This certificate regulates the necessary framework regarding the warranty of products of origin, exchange products of origin, homologated or certified products, exploitation materials, as defined in Government Ordinance (OG) 80/2000 and Annex OMTCT no. 2.135/2005, maintenance materials, and reconditioned products intended for road vehicles introduced into the market by SC TURACO MANAGEMENT SRL, which are sold/distributed to consumers, hereinafter referred to as products/materials.

  2. In the context of this certificate, the terms below have the following meanings: the consumer is defined according to art. 2 para. 2 of OG 21/1992 republished with subsequent modifications and additions, and art. 2 lit. a) of Law 449/2003, the seller is a natural or legal person authorized, who, in the course of their business, sells products introduced into the market by SC TURACO MANAGEMENT SRL under a contract concluded with the consumer, the auto service unit is the economic operator with the adequate technical capability to carry out repair, maintenance, and/or functional adjustment activities for road vehicles, product reconditioning, as well as chassis and/or body replacements of vehicles, and who, following an evaluation, has been authorized by the Romanian Auto Registry (RAR) according to OMTCT no. 2.131/2005.

  3. The warranty under this certificate applies to the products and materials mentioned in point 1, which are purchased by consumers from sellers SC TURACO MANAGEMENT SRL, appropriately identified through fiscal receipts/invoices/repair estimates.

3.1. The products covered by this warranty certificate are guaranteed for defects that may occur during the warranty period. The product warranty is for 24 months, calculated from the date of purchase, except for products with an average usage duration of less than 1 year, as follows:

  • Bulbs: 3 months;
  • Wipers: 6 months;
  • Suspension and steering component parts: 3 months for taxi use, driving school, vehicles with specific purposes. The warranty is granted in accordance with the provisions of Law 449/2003.

3.2. Exploitation materials have a validity period of at least 24 months if transport, storage, preservation, and handling conditions are respected, calculated from the manufacturing date indicated on the packaging/container.

3.3. Maintenance materials have a validity period of at least 24 months if transport, storage, preservation, and handling conditions are respected, calculated from the manufacturing date indicated on the packaging/container.

3.4. Auto batteries have a warranty period of 24 months, calculated from the date of purchase. Exceptionally, batteries for truck-type vehicles for motorcycles have a warranty period of 1 year, and batteries for specific purposes have a warranty period of 6 months, from the date of purchase.

3.5. The warranty is granted for non-compliance and/or hidden defects.

3.6. The warranty for labor is 3 months from the date of issuing the invoice that includes the labor.

3.7. If the product is not in working condition as warranted, the remedies will consist, in this order, of: repairing, replacing the product, or, if this is not possible, refunding the purchase price, in no case will SC TURACO MANAGEMENT SRL, and authorized distributors or dealers be liable for any damages exceeding the purchase price of the product.

  1. The warranty granted by this certificate does not affect the consumer's rights.

4.1. The legitimate rights of the consumer are provided in Chapter III, articles 9-14 of Law no. 449/2003 on the sale of products and associated warranties, Ordinance no. 21/1992 on consumer protection, Law no. 296/2004 on the Consumer Code.

  1. METHODS OF ENSURING WARRANTY MAINTENANCE, REPAIR, REPLACEMENT

5.1. In case of non-compliance/hidden defects found/occurring during the warranty/validity period of the product or material, the consumer can request its repair or replacement.

5.2. The warranty claim will be addressed to SC TURACO MANAGEMENT SRL and will be submitted to the seller or the auto service unit from which the product or material was purchased, as mentioned in the purchase documents from point 3, accompanied by the following documents:

a. Copy of the purchase invoice/fiscal receipt for the product/material issued by the seller. b. Copy of the installation/repair estimate and invoice/fiscal receipt issued by the auto service unit. c. Warranty certificate for the product/material, in original, completed accordingly, signed by the seller and the consumer. d. Copy of the vehicle registration certificate or identity card of the vehicle for which the product or material is subject to warranty. e. Copy confirming the validity of the vehicle's periodic technical inspection. f. Note of non-compliance or hidden defect of the product/material issued by the auto service unit.

5.3. If the warranty claim is justified, SC TURACO MANAGEMENT SRL will repair/replace the non-compliant products/materials within 15 calendar days from the date of submitting the warranty claim, through the seller or the auto service unit from which they were purchased by the consumer.

5.4. In case of warranty claims invoking hidden defects, SC TURACO MANAGEMENT SRL will repair/replace the products/materials within 15 calendar days from the completion of the technical expertise carried out according to art. 13 para. (2) of OG 21/1992 if the manufacturer or the authorized technical body conducting the expertise have found the existence of these defects.

5.5. If for various reasons, SC TURACO MANAGEMENT SRL cannot ensure the repair or replacement of non-compliant or hidden-defect products/materials, it will provide the consumer with equivalent reparative measures according to art. 11 of Law no. 449/2003.

5.6. If the warranty claim is unfounded, the consumer will bear the expenses related to the investigation/expertise of the product/material claimed to be non-compliant or with hidden defects (postal, transportation, handling, diagnosis, expertise, disassembly, assembly, labor, materials used, and packaging costs).

5.7. Products and materials replaced during the warranty period become the property of SC TURACO MANAGEMENT SRL and will be handed over by the consumer to the seller or the auto service unit.

  1. SITUATIONS THAT EXEMPT SC TURACO MANAGEMENT SRL FROM WARRANTY LIABILITY OR LEAD TO THE EXPIRATION OF THE WARRANTY OF THE PRODUCT/MATERIAL.

6.1. The product/material purchased by the consumer has not been introduced into the market by SC TURACO MANAGEMENT SRL.

6.2. The consumer has wrongly ordered the product or provided incorrect identification data.

6.3. The consumer does not request the warranty within the period mentioned in this certificate, or does not submit any of the documents specified in point 6.3 (a-f), or they are completed incorrectly, incompletely, or inaccurately.

6.4. The consumer has lost the warranty certificate.

6.5. The product/material has been used for purposes other than those indicated by the manufacturer on other vehicles.

6.6. The products show normal wear and tear due to operation.

6.7. The products have not been mounted/installed

6.8. At the completion of the repairs, the auto service unit did not perform the verification, calibration, and adjustment operations required by the vehicle manufacturer or product manufacturer.

6.9. The product was incorrectly installed or together with worn-out, non-compliant, or modified related parts according to the manufacturer's specifications.

6.10. Wear or defect of the product is due to overloading, improper maintenance, or inadequate periodic adjustments/inspections, or unauthorized interventions on the product during its warranty period.

6.11. The product shows signs of dents, mechanical shocks, scratches, ruptures, cracks, bends, deformations, which are not attributable to it, or has been affected by external factors outside the normal functioning process.

6.12. The vehicle on which the product was installed was involved in an accident or suffered damages caused by external factors, atmospheric or otherwise (thermal, electrical, mechanical shocks).

6.13. The vehicle on which the product was installed was used for purposes other than those specified by the manufacturer or was operated under inappropriate conditions: starting with a robot or by towing, exceeding the maximum permissible weight, participating in sports competitions, rallies, or modifications to its installations and systems.

6.14. For vehicles used in special conditions: taxi services, passenger and cargo transport vehicles, ambulances, police cars, school cars, the warranty period is reduced to 3 (three) months for the entire range of products.

6.15. Unauthorized installation on the vehicle of equipment/accessories other than those from the factory equipment.

6.17. Deterioration or destruction of the product due to the consumer's fault due to transportation, handling, storage, preservation, improper use, or exposure to aggressive chemical substances or proximity to heat sources.

6.18. The serial/branding/constructive code or identification marking of the product has been erased, or it presents artisanal markings or stamping.

6.19. Disassembly into component parts or subassemblies of the products or damage to the seals applied by the manufacturer, where applicable.

6.20. The vehicle exhibits malfunctions in steering, braking, suspension, cooling, air conditioning, electrical systems, etc.

6.20. Improper use of the vehicle through: failure to perform break-ins, exceeding the thermal regime, exceeding the maximum allowed speed.

6.21. Defects in the products due to the presence of foreign bodies, dust, dirt in their operating areas (e.g., lubrication system, hydraulic, intake, etc.).

6.22. Non-compliance with the interval and schedule of technical inspections established by the vehicle manufacturer.

6.23. The vehicle for which the product is intended is not registered, or the periodic technical inspection has expired before the warranty case occurred.

6.24. Other situations in which warranties are excluded or lost:

  • Incorrect storage: deformation through incidents of bending, pressing, or hitting, proximity to heat sources, contact with aggressive chemical products, prolonged exposure to atmospheric factors.
  • Incorrect choice and installation of parts: non-compliance with the characteristics specified in the vehicle identification book, failure to observe the mounting position, incorrect choice of the part or use for a purpose other than indicated by the manufacturer.
  • The part has worn out or deteriorated due to overloading, incorrect or insufficient maintenance of the vehicle, failure to carry out periodic inspections according to the recommendations of the car manufacturer, the specialized workshop that performed the installation did not establish subsequent checks and adjustments according to the assembly technology or imposed by manufacturers.
  • Malfunctions in the operation of the vehicle, contact with chemical and oil substances.
  • The part was incorrectly chosen by the buyer or was used for a purpose other than indicated in the manufacturer's catalog.
  • The part was not correctly identified due to the buyer presenting erroneous data or documents, or it was not compared during installation with the part to be replaced.
